WHAT TO DO LEGALLY AFTER A LOVED ONE DIES
Losing a loved one can be overwhelming. The information below outlines general legal steps families may need to consider in Louisiana. Not every estate requires court involvement.
1
Obtain Certified Death Certificates
You will typically need multiple copies for banks, insurance companies, Social Security, real estate and vehicle title transfers. Your funeral director can assist with ordering these.
2
Locate Important Documents
Last Will and Testament
Trust documents
Life insurance policies
Property deeds and vehicle titles
Bank and investment account statements
Mortgage statements
Recent tax returns
3
Determine Whether a Succession (Probate) is Required
The deceased owned real estate in their name alone; accounts without named beneficiaries; no valid trust; assets exceed small-estate thresholds; or title must be transferred to heirs.
DO NOT IMMEDIATELY:
Remove the decedent's name from property titles
Withdraw funds from financial accounts unless legally authorized to do so
Transfer vehicles without proper documentation
Distribute personal property without first confirming heirship
4
Check for Beneficiary Designations
Life insurance policies
Retirement accounts (IRA, 401(K))
Payable On Death (POD) bank accounts
Transfer On Death (TOD) investment accounts
5
If Minor Children Are Involved
Special legal considerations may apply regarding guardianship, trusts and court oversight.
6
When to Consult a Succession/Probate Attorney
You are unsure whether probate is required; real estate must be transferred; there are multiple heirs; there is potential family disagreement; a Will needs to be probated; or the estate includes business interests.
